A subpoena orders a person to appear in court or at a deposition, or to provide documents or records.

A subpoena to testify requires a person to show up and answer questions. A subpoena duces tecum requires a person or business to produce documents or evidence.

Pin Tip

Witness fees and mileage may need to be paid with certain subpoenas, so check the court’s rules.

Deadlines Matter

Subpoenas often need to be served a certain number of days before the court date, so serve them early.
